Acceptance and Definitions

By creating an account or using SafeLead, you agree to these terms. If you don’t agree, don’t use the service.

Key terms used throughout:

  • Service — the SafeLead platform, including the dashboard, APIs, tracking script, and all related tools at safelead.ai
  • User — anyone with a SafeLead account (publisher or buyer)
  • Publisher — a user who installs the tracking script to generate consent certificates
  • Buyer — a user who looks up and retains certificates for leads they’ve purchased
  • Certificate — an immutable record of consent evidence generated when a form is submitted on a publisher’s site
  • Vault — long-term, buyer-isolated storage where retained certificates are kept for 5 years
  • Retain — the action of moving a certificate from hot storage into a buyer’s vault for long-term preservation

Accounts and Eligibility

To use SafeLead, you must:

  • Be at least 18 years old
  • Provide accurate, complete registration information
  • Keep your login credentials secure
  • Accept responsibility for all activity under your account

One person per account. If you need multiple users, each person creates their own account within your organization.

Service Description

SafeLead provides:

  • For publishers — a tracking script that captures consent evidence (page URL, timestamp, consent text, session replay, browser metadata) and generates a certificate for every form submission
  • For buyers — an API and dashboard to look up certificates by ID (free), retain them to vault storage for 5-year preservation (paid), and export evidence for compliance use
  • Dashboard — domain management, certificate browsing, replay viewing, usage metrics, and export tools for both publishers and buyers

Acceptable Use

You agree not to:

  • Use the service for any purpose that violates applicable law, including TCPA and state telemarketing regulations
  • Circumvent rate limits, access controls, or other technical safeguards
  • Attempt to access certificates, data, or accounts that don’t belong to you
  • Interfere with or disrupt the service, including generating fraudulent certificates
  • Reverse-engineer, decompile, or extract source code from the tracking script or APIs

If you’re a publisher generating consent certificates, you’re responsible for ensuring your forms include clear, compliant consent language. SafeLead captures whatever consent text is present — we don’t validate whether your language meets legal requirements.

Fees, Billing, and Payment

Current pricing is published at safelead.ai/pricing. Publishers pay monthly subscriptions based on certificate volume. Buyers pay per retained certificate — lookups are free.

  • All payments are processed by Stripe. By subscribing, you agree to Stripe’s terms of service.
  • Subscriptions renew automatically at the start of each billing cycle unless cancelled.
  • If a payment fails, we’ll notify you and retry. If payment isn’t resolved within 14 days, we may suspend your account.
  • We may update pricing with 30 days’ notice. Changes apply at the next billing cycle, not mid-cycle.

Data and Certificates

SafeLead is a data processor, not an owner. You own your data:

  • Publishers own the form submission data captured by the tracking script
  • Buyers own the certificates they retain in their vault

Deletion works like this:

  • Certificates in hot storage are automatically deleted 90 days after creation if not retained by a buyer
  • Retained certificates remain in vault for 5 years (TSR-compliant per 16 CFR § 310.5), then are permanently deleted
  • You can export your data at any time via the dashboard (PDF, JSON) or API

Intellectual Property

SafeLead owns the platform — code, design, documentation, trademarks, and all related intellectual property. Your use of the service doesn’t transfer any ownership of the platform to you.

You retain full ownership of your data. We don’t claim rights over your form submissions, certificates, or any data you provide.

Disclaimers and Liability Limits

SafeLead provides evidence tools, not legal advice. Specifically:

  • Consent certificates capture and preserve evidence of what happened on a web page. They support your compliance efforts but do not guarantee immunity from legal claims.
  • We do not verify the legal sufficiency of consent language on publisher forms. You are responsible for ensuring your consent language meets applicable regulatory requirements.
  • We are not a law firm. Nothing in the service constitutes legal counsel. Consult an attorney for compliance questions specific to your business.

The service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, SafeLead’s total liability for any claims arising from your use of the service is limited to the fees you paid us in the 12 months preceding the claim.

Termination

Either party can terminate at any time. You can close your account from the dashboard or by emailing us. We may terminate accounts that violate these terms.

After termination:

  • Vault access — you have 30 days to export retained certificates from your vault. After 30 days, vault data is permanently deleted.
  • Account data — deleted 30 days after account closure.
  • Published certificates — certificates generated by a terminated publisher account remain accessible to buyers until they expire (90 days) or are retained.

Governing Law and Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Before filing a formal dispute, both parties agree to attempt resolution through good-faith negotiation for at least 30 days. If that fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations or data breaches.

Changes to These Terms

We may update these terms. Material changes will be communicated by email at least 30 days before taking effect. Continued use of SafeLead after changes take effect means you accept the updated terms.
